Cycling Terms & Conditions
| DEFINITIONS AND INTERPRETATION The following definitions apply throughout these Cycling Terms and Conditions and the Website Terms and Conditions. “Balance”, means the price of the relevant Ride less the Deposit. “Booking”, means booking a Ride in accordance with clause 1. “Booking Form”, means the booking form on the Website. “Business Day” means a day (other than a Saturday or a Sunday) on which banks in the City of London are open for general banking business. “Cancellation”, means cancellation of a Booking by the Participant. “Company” or “Love Velo”, means Love Velo Ltd, incorporated in England and Wales with registered number 6940085, and whose office is located at 8 Holmdale Road, West Hampstead, London NW6 1BP. “Deposit”, means a non-refundable deposit (subject to clause 4) of £200. “Employees”, means the employees of the Company from time to time. “Force Majeure Event”, means war, threat of war, riots, civil strife, terrorist activities, industrial disputes, natural or nuclear disaster, fire, adverse weather conditions, floods, technical problems of transport, closure or congestion at airports or ports, cancellation or changes of schedule by airlines or similar events and any other event which in the reasonable opinion of the Company would result in a Ride becoming unsafe or dangerous for the Company to run. “Participant” means the individual who has booked a Ride. “Ride”, means a bicycle riding holiday offered by the Company from time to time, in accordance with information provided on the Website. “Ride Commencement Date”, means the date a relevant Ride is scheduled to begin, in accordance with clause 7.1. “Ride Price”, means the price of a Ride as advertised on the Website from time to time. “Website”, means www.lovevelo.co.uk, and other websites operated by Love Velo from time to time. 1 MAKING A BOOKING To make a Booking, the Participant must provide the Company with: (a) a completed Booking Form (or the information required by the Booking Form if a Booking is made over the phone); (b) the Deposit; and (c) a declaration by the Participant that these Cycling Terms and Conditions, and the Acknowledgment of Risk and Liability, have been read and fully understood. 2 FINAL PAYMENT The Participant will pay Love Velo the Balance no later than 55 Business Days before the Ride Commencement Date. 3 CANCELLATION OF A BOOKING BY THE PARTICIPANT 3.1 Love Velo will only accept a Cancellation if made in writing (by post or email) and in accordance with the rest of this clause 3. 3.2 If a Cancellation is made less than 55 Business Days but not more than 10 Business Days before the Ride Commencement Date, the Participant will be refunded 50% of the Ride Price. 3.3 If a Cancellation is made less than 10 Business Days before the Ride Commencement Date, the Participant will not be entitled to any refund. 3.4 Love Velo accepts no responsibility for cancellation charges arising from delayed correspondence if beyond the control of the Company or failure by the Participant to secure insurance, relevant visas or flights. 4 CANCELLATION OF A BOOKING BY LOVE VELO 4.1 Love Velo reserves the right to cancel a Booking up to 14 days before the Ride Commencement Date for any reason. 4.2 Love Velo reserves the right to cancel your booking at any time if for a Force Majeure Event. 4.3 If a cancellation is made under this clause 4, Love Velo will refund all monies paid to it by the Participant. |
4.4 If a cancellation is made under this clause 4, Love Velo will not be responsible for any ancillary costs incurred by the Participant including, but not limited to, monies paid by the Participants for flights, insurance or visas. 5 CHANGES TO A RIDE Love Velo reserves the right to change the itinerary of a Ride from that which is advertised on the Website. 6 CYCLES IN TRANSIT 6.1 Love Velo is not responsible for any bicycle being lost, damaged, or its arrival at its destination being delayed where the Company does not offer the service of transporting bikes from the UK to the relevant Ride destination. 6.2 The Company shall not be responsible financially or otherwise for the inability of the Participant to continue with the Ride if an event under clause 6.1 occurs. 7 MEETING LOVE VELO 7.1 An Employee will meet the Participant at the designated meeting spot at the designated meeting time as advertised on the Website. The Ride does not begin until this time. 7.2 Love Velo will not be responsible for, nor incur any charges for, failure by the Participant to meet the Employee at the correct time and place. 8 SPECIAL REQUESTS Love Velo will seek to accommodate special requests made by a Participant but this cannot be guaranteed. 9 CONTRACTUAL RELATIONSHIP Contracts made between Love Velo and the Participant is effective on Love Velo’s written confirmation invoice to the Participant and is governed by English Law. Both parties agree to submit to the jurisdiction of the English Courts. Participants are also subject to the conditions of carriage of any carriers used (which may limit or exclude liability to you), or other companies for whom we act as agents. Bookings are accepted at the discretion of the Company. 10 INFORMATION Information provided by Love Velo on flights, visas, insurance and other essentials are given in good faith, but a Participant is liable for checking the accuracy of such information. 11 WEBSITE AND MARKETING 11.1 Photographs, likenesses or images of Participants secured or taken on any of Love Velo’s Rides may be used by the Company without remuneration to the Participant in all media for bona fide promotional or marketing purpose. 11.2 Photographs, likenesses or images displayed on the Website are for marketing purposes and do not necessarily represent the exact location of the relevant Ride. 12 LOVE VELO'S LIABILITY TO THE PARTICIPANT Except in respect of death or personal injury caused by the negligence of Love Velo, neither Love Velo nor its employees or agents will have any liability (whether in contract or in tort, including negligence) for any loss, damage, injury or death which the Participant may suffer in connection with a Ride, nor for any failure by the Participant to take out travel insurance as advised by the Company in the Acknowledgement of RIsk and Liability. 13. DATA PROTECTION13.1 In order to process a Booking and ensure the Participant receives the maximum enjoyment from the Ride, Love Velo needs to use the information that a Participant provides. This information includes, but is not limited to, the Participant's name, address, age, any special needs they have or any special dietary requirements they have. 13.2 The information described in clause 13.1 will be passed on to the suppliers and brokers that Love Velo uses for the relevant Ride. Love Velo takes full responsibility for ensuring that proper security measures are in place to protect a Participant’s information whilst the information is with the Company. |
